How to report alleged copyright infringement, and how we respond.
PokemonPricing.com respects the intellectual-property rights of others and expects users to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
1. Filing a DMCA Takedown Notice
If you believe content on this site infringes a copyright you own or control, please send a written notice that includes all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material that is claimed to be infringing, with information reasonably sufficient for us to locate it (URLs work best).
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
2. What Happens After You File a Notice
Once we receive a complete notice, we will review the claim and, if appropriate, remove or disable access to the material in question. We may also notify the user who posted the material. Repeat infringers may have their access to the site terminated.
3. Counter-Notice
If you believe your content was removed in error or as the result of misidentification, you may file a counter-notice that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and its previous location on the site.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed in error or misidentification.
- Your name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the appropriate federal district court.
4. Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages.
